In a significant move highlighting the growing strain on Iowa’s public defense system, the Iowa State Public Defender’s Office has petitioned the Iowa Supreme Court to issue a writ of mandamus directing the Seventh Judicial District Court in Scott County to enter an order withdrawing the local state public defender as counsel in 10 cases.
The petition states that the local public defender's office has filed a motion to withdraw in each case, citing "temporary overload," yet the district court has not granted the motions, leaving defendants without legal representation for extended periods.
The writ of mandamus is an extraordinary legal remedy that compels a court or government official to perform a legally required duty. In a Quad-Cities Times article, State Public Defender Jeff Wright described the filing as "unfortunate and not common."
