Lockton: Email impersonation newest threat for attorneys

Lockton Risk Services is warning lawyers about a particularly damaging new scam involving real estate and legal settlement transactions. Criminals attempt to impersonate payment recipients via email and convince lawyers to wire awarded funds to a fraudulent bank account.

According to Lockton’s brief on the issue, the process begins when hackers access and monitor a lawyer’s email traffic in order to learn when funds will be transferred. Then a near identical email is used to provide the bad bank information for the transfer. Funds are then transferred overseas via a third party in order to avoid recovery.

The scam also includes sending phony emails to clients about delays in the payments in order to extend the time for detection. The FBI says this has already been successfully carried out on attorneys in several states, leaving those affected liable not just for client funds, but also for professional misconduct proceedings in failing to protect the funds.

Lockton urges attorneys to focus on details when emailing clients, as well as continually keeping up-to-date firewall and anti-virus programs in order to protect against this and other scams.
