IRS issues interim guidance on computing business interest expense
The U.S. Treasury Department and the IRS issued Notice 2018-28 Monday (April 2), which provides guidance for computing the business interest expense limitation under the recent tax legislation enacted on Dec. 22, 2017. The notice provides guidance until permanent regulations are enacted.
In general, newly amended section 163(j) of the Internal Revenue Code imposes a limitation on deductions for business interest incurred by certain large businesses. For most large businesses, business interest expense is limited to any business interest income plus 30 percent of the business’ adjusted taxable income.
The notice further describes certain aspects of the rules that those proposed regulations will include to provide taxpayers with interim guidance as more comprehensive guidance is developed. The rules described in this notice apply only for purposes of determining the limitation on deductions for interest expense under section 163(j), as amended by the recent tax legislation. Before the issuance of the regulations described in this notice, taxpayers may rely on the rules described in sections 3 through 7 on pages 5-11 of the notice.
Two ISBA members to offer information on magistrate, district associate judge nomination process
Polk County Magistrate Appointing Commission members Mark Schuling and Maria Brownell are offering to discuss the process for nominating magistrate or district associate judges in Polk County. Commission members appoint the Polk County magistrates. They also interview applicants for district associate judge positions and choose three to send to the Polk County judges to fill a vacant position.
“We do not meet with potential candidates when a selection is in process, but both Maria and I would be happy to meet with attorneys to discuss either process,” Shuling wrote in an email to YLD Vice President Maggie White. “We are the commission members elected by attorneys in Polk County.”
Anyone interested in the magistrate or district associate judge nomination processes should contact Shuling at firstname.lastname@example.org, or Brownell at email@example.com.
