Tim Gartin (Hastings, Gartin & Boettger, LLP) ponders "how far can a lawyer go to assist a client in preserving assets from a potential creditor?" This is the broad question that Justice Waterman poses as the first line of the Ouderkirk opinion. This is a case of first impression in Iowa and one of great importance for Iowa attorneys to understand. In the midst of facts that might well have yielded a different conclusion, this session offers attendees a unique opportunity to look at the boundaries of zealous attorney representation.
