Dr. Holger Tostmann will discuss patent practice in Europe with a threefold objective: first: outline newly available filing options for an applicant seeking patent protection in Europe (European Patent Convention and European Union) and compare these new options to already existing filing options, also on the national level; second: provide an update on the Unitary Patent, which is now expected to enter into force in the first quarter of 2017 (the costs for prosecution and litigation are now fixed; the court structure and system is by-and-large defined by now and, most importantly, strategic considerations will be provided whether or not to opt out of the Unitary Patent, which is a point that needs to be considered for all existing EP patents, even pre-UPC); third: provide practical guidelines on points to be considered when  drafting a first filing for the US that is anticipated to also enter into prosecution in Europe (claims structure, multiple dependencies, identifying the problem, functional features, preparing for potential amendments, among others).
