R. Mark Halligan will discuss recent legal developments in trade secret law including recent cases in both state and federal courts and include a review of business-essential trade secret cases regarding reasonable efforts to protect information so that courts award trade secret protections. He will also cover the status of and prognosis for the proposed Federal trade secrets law and provide an update on the likelihood of amendments to the Economic Espionage Act to add a federal civil cause of action and ex parte seizure provisions to the EEA. Also covered will be employee conversions of trade secrets case study in the DuPont/Kolon case, as well as protecting trade secrets in cases of Freedom of Information Act requests of government entities in the event of government contracts in view of escalated FOIA press requests and coverage.
