The age of knowing your biases is upon us. We have the ability to know, understand and reduce the impact of our implicit biases upon how we make decisions. Lawyers are as much at risk of implicit bias as anyone. Judges, prosecutors, defense lawyers, civil litigators – we all make judgments about persons that can be impacted by race, gender, age or other key protected characteristics. Whether taking a case, or determining the value of that case or defending a case or deciding a case, our ethical standards require that we take reasonable steps to reduce the impact of not just open stereotypes, but more hidden biases that affect the advice we give to our clients and how we choose to pursue the case.
