Supreme Court reverses, remands verdict against subcontractors

The Iowa Supreme Court reversed a district court’s ruling that granted the Iowa Department of Transportation's (IDOT) motion to dismiss subcontractors’ claims for funds in excess of the retained funds after the general contractor failed to pay the claims. The state had waived the performance bond requirement for the general contractor because it is considered a "Targeted Small Business." The court remanded the case to allow the subcontractors’ claims to proceed against IDOT for unpaid work on the projects, interest, costs, and reasonable attorney fees incurred in district court and on appeal.
