We have been getting many calls and emails about the addition of the signature line on the Authorization For Release of Health Information page of these forms (Forms #121 and #123). Below is a statement of explanation from the ISBA's Legal Forms Committee:

"The Durable Power Of Attorney For Health Care Decisions (Form #121) and Combined Living Will and Medical Power of Attorney (Form #123) is in effect only when the principal is unable to make health care decisions. The Authorization For Release of health information was added to the POA forms to allow the person nominated as attorney in fact/agent to receive confidential health information showing whether the principal is unable to make health care decisions, and whether the POA is in effect."
