This presentation will examine the
Iowa Rules of Professional Conduct and the Rule’s impact on the role and
obligations of counsel. The presentation will then focus on a circuit
split that has developed regarding the impact of civil protective orders on
federal grand jury proceedings. Presently, there are the three separate
and distinct lines of cases which are currently employed by the federal courts
of appeals in determining this issue. Next, this presentation
discusses Chapter 8 of the United States Sentencing Guidelines and how
organizations can decrease potential fines and penalties by early detection of
criminal conduct through corporate compliance programs. Finally, the
presentation will recap the current state of affairs on waiver of the
attorney-client privilege in federal investigations.
