This three-week lunch and learn live webinar series will focus on the necessity of prompt analysis of the farmer’s financial situation to determine if partial liquidation or complete liquidation is necessary to right-size the operation for survival. Right-sizing generally leads to adverse tax consequences which the farmer must address.

PROBLEM IDENTIFICATION & CHAPTER 12
November 7
Problem identification and planning a solution. Planning for a Chapter 12 to restructure payment obligations and deal with income taxes due to the sale of farm assets will be examined.

DEALING WITH BANKS – RESTRUCTURING/FORECLOSURE
November 14
Review of traditional foreclosure, non-judicial foreclosure, and deeds in lieu of foreclosure. The availability of the right of redemption and first right of refusal in these methods of foreclosure will be examined.

TAX PITFALLS OF POOR TIMING
November 21
The tax pitfalls of poor timing including tax on forgiveness of debt as well as tax on non-recourse debt will be examined. Potential solutions to the tax pitfalls, both in and out of bankruptcy will be compared including discharge of taxes in Chapters 7, 11, and 12. Offers in compromise, and installment agreements with the IRS will also be reviewed.
